The recently formed Commercial Court of Abu Dhabi Judicial Department has settled a dispute valued at AED 52 million ( 15 million USD ) in a record time of just 12 days from the date the lawsuit was filed to the date of judgment. The dispute related to the implementation of a sale contract between an international holding company and a bank.
Historically, a dispute of this nature may endure an average of 8 sessions taking place over 180 days. Since the formation of the Commercial Court, in less than two months, it has issued 1500 judicial decisions. It has also settled over 420 orders for payment within one week following registration of the case which confirms that the priority of the judiciary is to strengthen the enforcement of contracts.
The Undersecretary of the Judicial Department, His Excellency Chancellor Yousuf Saeed Alabri, has reiterated that the efficiency of justice and prompt settlement of disputes is one of the most important objectives set by His Highness Sheikh Mansour Bin Zayed Al Nahyan, Deputy Prime Minister, Minister of Presidential Affairs and Chairman of Abu Dhabi Judicial Department.
His Excellency Chancellor has also stated that this landmark case exemplifies that such an objective is having a profound impact on commercial matters and is a positive indicator that the Emirate of Abu Dhabi provides a highly attractive environment for investment.
In 2019, the Emirate of Abu Dhabi was ranked eighth globally and first regionally in the contract enforcement index which measures the effectiveness of the judicial system in adjudicating commercial disputes.
